The Boland Falconry Club successfully obtained its new CapeNature falconry permits on July 21, 2021. It is noteworthy that at no time between December 12, 2020, and February 21, 2021, did CapeNature(CN) instruct the BFC to cease falconry activities or suspend any captive permits held by its members. Consequently, with their CN permits in hand, the only significant item remaining for the BFC was to conduct its 2021 Annual General Meeting.

SAFA vs BFC

A SAFA position statement was circulated to all SAFA Executive Committee (Exco) members via email. This communication invited comments by August 21, 2021, with the apparent intention that the statement's contents would then be subject to a vote.

Upon careful review, the BFC2020MC perceived the SAFA position statement as a deliberate attempt to misrepresent the BFC’s situation and actions.

Consequently, the statement was immediately forwarded for legal review. Considering the contents of SAFA’s statement alongside the history of exchanges between the BFC2020MC and SAFA, the BFC2020MC concluded that the statement was misleading, contained inaccuracies, and constituted an attempt to tarnish the BFC’s reputation.

Acting on legal advice, and in light of the escalating situation and SAFA’s perceived lack of impartiality, the BFC2020MC was counselled to formally respond to the allegations. Furthermore, it was strongly recommended that the BFC request the appointment of an independent tribunal to adjudicate the contentious matter between SAFA and the BFC. The deadline stipulated for SAFA member responses to the position statement was August 21, 2021. The BFC strategically submitted its comprehensive comments on SAFA’s statement at 9:00 PM on this date. The BFC2020MC’s formal response articulated several key concerns regarding SAFA’s conduct and the timing of its interventions, specifically questioning:

Why SAFA had not addressed the BFC’s historical non-compliance issues (from 2018 to 2020) with the previous BFC management committees, and why the 2021 BFC Management Committee was now seemingly being held accountable for these past failures.

Why did SAFA raise no concerns regarding the interim BFC management committee, elected at the Special Committee Meeting in November 2020, until August 2021, despite being informed at the time?

– Why the IBFC2020MC’s proactive disclosure of its non-compliance status to the SAFA Exco in February 2021 was not addressed promptly, only becoming a ‘SAFA Concern’ in June 2021.
